Work and Law in the age of AI and Digitalization – comparative research of Japan and Korea

Labor law has always been in close relation with social development and changes. The nature of work, which is the very object of regulation, is changing with rapid digitization and introduction of artificial intelligence, and this inevitably promotes a change in regulation. Improving the maintenance of working conditions or secure the minimum standard, as the uniform protection proposed by the existing labor law became difficult, establishing autonomous working conditions through labor-management negotiations was re-examined as an important mechanism. However, as the meaning of work itself, and many other concepts of work and law are changing, we do need to reconsider the classical way of thinking labor and law, to cope with new changes of industry and society. This session aims to diagnose and confirm what transitions people working in connection with society and industry experiencing these changes are facing, how regulations respond in both Korea and Japan, and how the field of law harvests or leads them.
